1. These terms
These Terms of Use govern your use of the TellWay mobile application. By installing or using the app you accept them. If you do not accept them, do not install or use the app.
The app is published by Tutatechno, a sole trader registered in Hungary (“we”, “us”). Contact: tutatechno@gmail.com. Full registered details are held by Google Play and are supplied on request to any user, court or authority entitled to them.
2. Licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use one copy of the app on devices you own or control, for your own purposes.
This is a licence, not a sale. All rights not expressly granted here are reserved.
3. What you may not do
You may not, and may not permit anyone else to:
- copy, reproduce, distribute, sell, rent, lease, sublicense or otherwise make the app available to others;
- reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, algorithms or internal structure of the app, except to the narrow extent this cannot lawfully be prohibited under Article 6 of Directive 2009/24/EC;
- modify the app, create derivative works from it, or remove, obscure or alter any copyright, trademark or attribution notice;
- extract, re-host or reuse any graphic, icon, sound, text, layout or data file contained in the app;
- reuse the app's query logic, place-selection rules or narration templates in another product;
- republish the app, in whole or in substantial part, under a different name, or produce a substantially identical application from its content;
- use automated means to access, interact with or generate activity in the app, including any activity that artificially inflates advertising metrics;
- use the app unlawfully, or in a way that infringes the rights of others.
4. Intellectual property
The app and everything in it — its source code, compiled binaries, interface design, layout, graphics, icons, illustrations, animations, sounds, music, text, structure, and the selection and arrangement of its content — is our property or is licensed to us, and is protected by copyright, database rights and other intellectual property laws in Hungary, the European Union and internationally.
The name TellWay, the name Tutatechno, and the associated logos and visual identity are our marks. You may not use them to identify any product or service that is not ours, nor in any way that suggests endorsement, affiliation or origin that does not exist.
Nothing on this website or in the app operates as a waiver of any right, and no delay in enforcing a right waives it.
5. Your content
Anything you create in the app — your saved places, settings and any API keys you supply — remains yours. We claim no ownership of it and no licence over it. It is stored on your device; how it is handled is set out in the Privacy Policy, which forms part of these Terms.
You are responsible for what you create with the app and for having the rights to any material you bring into it.
6. Third-party material and services
Place descriptions are drawn from open databases and remain under their own licences: Wikipedia and Wikivoyage (CC BY-SA), Wikidata (CC0), OpenStreetMap (ODbL). Attribution is shown in the app and must not be removed. Those licences govern the source material; they do not extend to the app itself, its code, its interface or its narration logic.
Road safety. The app is an audio companion, not a navigation system. You remain solely responsible for operating your vehicle lawfully and safely, for obeying traffic law, and for not interacting with the screen while driving.
Where the app displays advertising, it is delivered by Google AdMob and is subject to Google's own terms and policies. We do not control which specific advertisements are shown.
7. Updates and availability
We may update, change, suspend or discontinue the app or any of its features at any time, and we do not undertake to keep any particular feature available. Updates may be delivered through Google Play. Continued use after an update means you accept these Terms as they then stand.
8. No warranty
The app is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any defect will be corrected.
Nothing here excludes or limits the statutory rights you have as a consumer under Hungarian or EU law, which are not affected by these Terms.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, nor for lost data, lost profits, lost revenue or lost goodwill, arising out of or in connection with the app.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.
10. Termination
These Terms apply for as long as you use the app. They end automatically if you stop using it and uninstall it. We may end your licence immediately if you breach them; on termination you must stop using the app and delete it. Sections 3, 4, 8, 9 and 11 survive termination.
11. Governing law
These Terms are governed by Hungarian law, without regard to its conflict-of-law rules. If you are a consumer resident in the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
12. Changes to these terms
We may revise these Terms. The date at the top of this page shows the current version, and material changes will be announced in the app's release notes.
